Summary
The Pollution Prevention and Control (Industrial Emissions) Regulations (NI) 2013 came into effect on 20 June 2013 and place responsibilities upon operators of a variety of activities to control and monitor air pollution (and to a lesser extent water pollution). They also require certain information is provided by permit holders to enforcing authorities for inclusion in public registers.
The administration of these controls for activities classed as ‘Part C’, as outlined in Schedule 1 of these Regulations, has been allocated to Councils. An example of these activities is dry cleaning using organic solvents (SED* activities, Section 7, Schedule 1, PPC Regulations, as amended).
The Regulations require the ‘permitting’ of both new and existing activities within Schedule 1. Permit conditions are attached to ensure that no significant pollution is caused on the basis of ‘best available techniques’ (known as BAT). Will Tacit Consent Apply?
No. Once your form is submitted, the Council has 6 months to determine the status of the application. This allows Antrim and Newtownabbey Borough Council to assess the public health impact of your activity and completely process your application. You should maintain regular contact with the section and where you have not received confirmation within this time, contact the Environmental Health team on 028 9034 0000 or 028 9446 3113.
Cost of Registration
The Regulations make provisions for fees and charges payable to the enforcing authority. The current fee schedule PPC Charging Scheme details all permit application fees as well as annual subsistence charges and transfer charges. You should contact Environmental Health to discuss this in more detail.

Public Register
This register contains information on all LAPPC installations and mobile plant as regulated by Antrim and Newtownabbey Borough Council. Information is also held for all Part A and B installations as regulated by the Chief Inspector of the Northern Ireland Environment Agency (NIEA) as is required by regulation 33 of the above legislation.
This register is available for inspection Monday-Friday between 09:00 and 17:00 (excluding public holidays) and is free of charge.

Failed Application Redress
Please contact Antrim and Newtownabbey Borough Council in the first instance. Applicants will be notified by the Council within 10 working days about the validity of the application. You may appeal against a decision to the Planning Appeals Commission.
